Newcastle Brown Ale “Best of Both Worlds” Sweepstakes: Complete Rules

1. SPONSOR: The “Newcastle Brown Ale Best of Both Worlds Sweepstakes” is sponsored by Scottish and Newcastle Importers, Co.

2. HOW TO ENTER: There is no purchase necessary. A purchase will not increase your chances of winning. Open only to legal residents of the U.S. aged 21 or older at time of entry. Void in California (CA) and where prohibited by law. Void via online entry in Tennessee (TN). One entry per person accepted. Complete the mail-in entry form or the entry form located online at http://www.newcastlebrown.com. There are no other methods of entry. Sponsor is not responsible for and shall not be liable for: (i) undelivered, illegible, lost, stolen, late, garbled, misrouted, damaged, incomplete, or misdirected entries, winner notification telephone or e-mail; (ii) lost, interrupted or unavailable network server or other connections; (iii) telephone, electronic, electrical, hardware, software program, Internet, network or computer malfunctions, failures, delays, miscommunications or difficulties of any kind; (iv) jumbled, failed, garbled, scrambled or misdirected transmissions; (v) other errors of any kind whether human, typographical, printing, mechanical or electronic; or (vi) damage of any kind resulting from participation in the Sweepstakes. Persons found tampering with, compromising, or abusing any aspect of this Sweepstakes, as solely determined by the judges, will be disqualified. If disqualified for any of the above reasons, Sponsor reserves the right to terminate entrant’s eligibility to participate in the Sweepstakes. Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.

In the event any portion of this Sweepstakes is compromised by virus, bugs, non-authorized human intervention, technical problems, or other causes beyond the control of the Sponsor which, in the opinion of Sponsor, corrupts, or impairs the administration, security, fairness or proper submission of entries, Sponsor reserves the right, at its sole discretion, to suspend or terminate the Sweepstakes. Sweepstakes begins at 12:00 AM EST on September 1, 2004 and ends at 11:59 PM EST on September 30, 2004.

3. PRIZE DETAILS: One Grand prize winner will be randomly chosen from among all eligible entrants who have registered online by 11:59 PM EST on September 30, 2004 or who have registered through the mail via mail-in entry forms post-marked by October 7, 2004 and received no later than October 20, 2004. All prizes will be randomly drawn on October 23, 2004. The Grand prize winner will be notified immediately. All other prize winners will be notified by December 1, 2004. Grand Prize: One winner (1), two trips (2). Trip one: trip for four (4) to Las Vegas, Nevada (February 4 - 6, 2005). Roundtrip airfare for four (4) to Las Vegas International Airport from nearest metro airport in continental U.S. and transportation to and from Las Vegas International Airport to Mandalay Bay Resort. Lodging for three (3) days, two (2) nights at Mandalay Bay Resort. Cash to winner $1500. Trip two: trip for two (2) to the British Virgin Islands (February 12 – 15, 2005). Roundtrip airfare for two (2) to The British Virgin Islands from nearest metro airport in the continental U.S. and transportation to and from Tortola Island airport. Lodging for four (4) days and three (3) nights at the Ritz Carlton, St. Thomas. Bouquet of flowers to hotel room, gift certificates for dinner and limousine roundtrip transportation to and from the Ritz Carlton, St. Thomas the evening of February 14, 2005. The Approximate Retail Value (“ARV”) of the Grand Prize is $10,000.00. TRAVEL DATES AND TIMES, AIRLINE AND HOTEL ARE AT THE SOLE DISCRETION SCOTTISH & NEWCASTLE IMPORTERS, CO. EXPENSES NOT SPECIFICALLY MENTIONED ARE NOT INCLUDED AND ARE SOLELY WINNER’S RESPONSIBILITY. NO SUBSTITUTION, CASH ALTERNATIVE OR TRANSFER OF PRIZE. Both the winner and companions of the winner will be required to sign and return liability releases prior to issuance of travel documents. Grand prize winner will also be required to complete, sign and return a 1099 tax form. Prizes are not transferable. Sponsor reserves the right to select the prize to be awarded and/or to substitute a prize with a similar prize of equal or greater value. Second prize: Four (4) flat screen TV and DVD gift-pack. (Gift-packs consist of 10 DVDs) Approximate retail value (“ARV”): $1,450. Third prize: Ten (10) DVD gift-packs (Gift-packs consist of 10 DVDs). Approximate retail value (“ARV”): $250. Fourth prize: Twenty (20) Best Buy Gift Certificates and Bath & Body Works Gift Certificates. Approximate retail value (“ARV”): ($50). Fifth prize: Fifty (50) Newcastle Brown Ale T-shirt (1 T-shirt). Approximate retail value (“ARV”): ($15). Please allow 6-8 weeks shipping for all prizes.

4. AWARDING PRIZES: Winners will be notified by e-mail and/or by phone. If a prize winner does not respond within 48 hours from date of notification, they automatically forfeit their prize and an alternate winner will be notified.

5. ODDS OF WINNING: Odds of winning are determined by the number of eligible entries received.

6. ELIGIBILITY: To be eligible to enter the sweepstakes, entrants must be residents of the United States and of legal drinking age in their state of residence. (Void in California (CA) and where prohibited by law. Void via online entry in Tennessee (TN). The following individuals and members of their families are not eligible for participation under any circumstances: employees of Scottish & Newcastle Importers, Co., its parent company, subsidiaries, affiliates, promotional and advertising agencies, beverage alcohol manufacturers, wholesalers, distributors, suppliers, importers and retailers. Prizes are awarded “AS IS” and WITHOUT ANY WARRANTY OF ANY KIND, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). All taxes and incidental expenses associated with the receipt of any prize are the sole responsibility of the winner. By accepting a prize, winners agree to release and hold Sponsor and its parents, subsidiaries and affiliates harmless from any and all losses, damages, liability, claims and actions of any kind resulting from participation in the Sweepstakes, or acceptance, possession, use or misuse of any prize, including without limitation, personal injuries, death, products liability, property damage and claims based upon publicity rights, false light, false endorsement, defamation or invasion of privacy. All entries become property of Sponsor and will not be returned. Acceptance of prize offered constitutes winner’s permission for Sponsor to use winner’s name, voice, statements, biographical information, photograph and/or likeness for purposes of advertising and promotion without further compensation, consideration or consent, as permitted by law.

7. RELEASE OF LIABILITY: All entrants agree to hold harmless and release Scottish & Newcastle Importers, Co. and its parent company, affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Web site and sweepstakes from any and all liability with respect to or in any way arising from this sweepstakes, any sweepstakes activity, or acceptance, possession, use, or misuse of a prize, including but not limited to liability for personal injury, bodily injury including wrongful death, damage to property, and damage or loss of any other kind. Sponsor is not responsible for prize quality or utility. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web-site users, by any of the equipment or programming associated with or used in the sweepstakes, or by any technical or human error that may occur in the processing of submissions in the sweepstakes. Sponsor assumes no responsibility for any error; omission; interruption; deletion; defect; delay in operation or transmission; communications-line failure; or theft, destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; computer online systems, servers, or providers; computer equipment; computer software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participant’s or to any person’s computer related to or resulting from participating or downloading materials from this Web site or sweepstakes. Sponsor is not responsible for user cheating or fraud by any entrants. Any activities intended to disrupt or interfere with the proper play of the sweepstakes or defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any prizes won. If, for any reason, the sweepstakes is not capable of running as planned, due to but without limitation to, infection by computer virus, worm or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, that in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the sweepstakes.

WINNERS LIST: To obtain a complete list of winners, send a self-addressed, stamped business size (#10) envelope to: Scottish & Newcastle Importers, Attn: Sweepstakes Winners,. 4040 Civic Center Drive, Suite 401, San Rafael, CA 94903 All requests for winners list must be postmarked by November 15, 2004 and received by November 30, 2004. 9. GOVERNING LAW: The Sweepstakes and Contest and these Official Rules are governed and to be construed under the laws of the State of California.
